1. Introduction
Welcome to RiverOrchardLane ("we," "us," or "our"). Your use of our yacht charter services and the website found at riverorchardlane.sbs (herein referred to as the "Service") is subject to these Terms & Conditions ("Terms").
In booking a charter or by using our Service, you accept these Terms in full. Should you disagree with any portion of these Terms, you must not utilize the Service.
2. Service Overview
At RiverOrchardLane, we offer a range of luxurious yacht charter services that include, but not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
We ensure service availability according to weather restrictions. The right to alter or withdraw services without prior notice is reserved by us.
3. Booking and Reservations
3.1 Booking Process
Charter booking requirements include:
- Minimum age of 18 years
- Accurate provision of all necessary details
- Payment of the deposit as outlined in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking becomes confirmed only after we receive the payment and issue a written confirmation. We maintain the right to refuse service at our discretion.
3.3 Availability
Charters depend on the availability of vessels and conducive weather conditions. We strive to accommodate your preferred dates and times where possible.
4. Payment Terms
4.1 Pricing
All pricing details are provided in € and account for all applicable taxes unless stated otherwise. Prices are subject to changes at our discretion.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost payable at the time of booking
- Balance: Payable 48 hours prior to charter commencement
- Any additional fees (if applicable): Payable after the charter completion
4.3 Payment Methods
Payments can be made using major credit cards, bank transfers, and certified cheques. Secure and encrypted processes are used for payment handling.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund less transaction fees
- Between 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
If the captain deems weather conditions as unsafe, options presented include:
- Rescheduling the charter at no extra charge for the next suitable date
- A full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there’s a mechanical problem with your assigned vessel, we will attempt to arrange an alternative. If this is not possible, a full refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Adhere to all instructions given by the crew
- Utilize the safety equipment provided when necessary
- Disclose any medical conditions that could impact their safety
- Stay inside the areas of the vessel designated for passengers
6.2 Prohibited Items
The following are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive beverages (beyond what is considered moderate consumption)
- Pets, except when approval has been granted prior
6.3 Conduct
Behaviour of passengers must be orderly and respectful. Any charter may be terminated early without a refund if passenger conduct becomes a safety concern or interferes with the enjoyment of other individuals.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter fee paid. Our responsibility does not extend to:
- Personal injuries caused by passenger negligence
- Lost or damaged personal items
- Indirect, consequential, or punitive losses
- Delays due to weather or unforeseeable events beyond our control
7.2 Insurance Coverage
We hold comprehensive insurance for our fleet and operations. Passengers should secure their own insurance for travel and personal belongings.
7.3 Assumption of Risk
Engaging in our charters signifies you are aware of inherent risks associated with marine activities and you accept responsibility for your own safety.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules may be changed due to weather, safety concerns, or operational necessities. We will make all attempts to provide a similar alternative experience.
9. Force Majeure
We shall not be liable for any delay, changes, or cancellations caused by events out of our control, including but not restricted to:
- Extreme weather conditions
- Natural disasters
- Government regulations
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
We handle your data according to our Privacy Policy. By engaging with our services, you consent to the collection and use of your information as detailed in the said policy.
11. Intellectual Property
All content on this website, such as texts, visuals, logos, and imagery, falls under copyright and trademark protection laws. Unauthorized reproduction, distribution, or creation of derivatives is prohibited without our express authorization.
12. Governing Law
The governing laws of Italy apply to these Terms. Any disputes will be handled exclusively by courts in Porto Cervo, Italy.
13. Changes to Terms
We can modify these Terms at any given time. Amendments will be posted on this website with the revision date. Continued use of the Service conveys acceptance of the new terms.
